What Is an Expungement in New Jersey?

An expungement is a legal process that removes arrests, charges, or convictions from your criminal case history, also known as your CCH. Once your record is expunged, it is as if the incident never happened for most purposes. This includes:

Job applications Housing opportunities Professional licensing Background checks

If your record is holding you back, expungement can be a life changing solution.

Important note for licensed professionals: Certain professions require that you report prior convictions even if you have received a court order expunging your New Jersey criminal history. For example, licensed professionals such as doctors or lawyers will likely still have to disclose arrests involving not only criminal charges, but even municipal level and driving offenses.

How It Works and Who Qualifies

To file an expungement, our office first determines whether you are eligible. We do this by examining the strict requirements of N.J.S.A. 2C:52-1, and so on.

According to New Jersey law, expungement means the extraction, sealing, impounding, or isolation of all records on file within any court, detention or correctional facility, law enforcement or criminal justice agency. These records relate to a person’s detection, apprehension, arrest, detention, trial, or disposition of an offense within the criminal justice system.

Expunged records include complaints, warrants, arrests, commitments, processing records, fingerprints, photographs, index cards, rap sheets, and judicial docket records.

The Expungement Process: We Handle Everything

Expungement involves several steps. We manage the entire process so you do not have to deal with the complexity or stress.

1. Gathering your complete criminal history 2. Determining eligibility under New Jersey law 3. Preparing and filing the petition 4. Serving multiple government agencies, including the local police department, the local municipal court, the Attorney General of New Jersey, the County ID Department, the County Probation Department, and the Superintendent of the New Jersey State Police 5. Attending court hearings if required 6. Ensuring records are fully cleared

Expungements in New Jersey can take time for the court to process. It is true that some superior courts process expungements faster than others. Delays have been attributed to COVID-19 as well as the legalization of marijuana in New Jersey, which led to thousands of expungement applications flooding the system. We help navigate these delays.

Frequently Asked Questions About Expungement in New Jersey

Q: How long does the expungement process take in New Jersey?A: It depends on the court and the complexity of your case. Some Superior Courts process expungements faster than others. Due to COVID-19 backlogs and the flood of applications following marijuana legalization, delays are common. On average, expect several months from filing to final order. We work to move your case as quickly as possible.
Q: Can I expunge multiple offenses at once?A: Yes, in many cases. New Jersey allows for expungement of multiple offenses under certain circumstances, including the Clean Slate Act after 10 years. We will review your record to see if you qualify.
Q: Will expungement completely erase my record?A: For most purposes, yes. Employers, landlords, and background check companies will not see expunged records. However, law enforcement and certain government agencies may still have limited access. Also, as noted above, some licensed professionals may still need to disclose expunged convictions.
Q: What is the Clean Slate Expungement?A: New Jersey’s Clean Slate Act allows for automatic expungement of certain records after 10 years without any new convictions. However, not all records qualify, and the system is still being implemented. We can help you understand whether you qualify for Clean Slate or need to file a traditional expungement petition.
Q: Can I expunge a domestic violence conviction?A: Under New Jersey’s expungement law (N.J.S.A. 2C:52-2), most domestic violence convictions are not eligible for expungement. This includes assault, harassment, stalking, and contempt of a DV order. That is why fighting the original charge is so critical. For other non DV offenses, expungement may be available.
Q: Do I need a lawyer to file an expungement?A: While you can file on your own, mistakes in the petition, incorrect waiting period calculations, or improper service to agencies can lead to denial or major delays. An experienced expungement lawyer ensures everything is done correctly the first time.
